Federal judge warns he may postpone election / U.S. must ensure minority rights not harmed

A federal judge in San Jose threatened Friday to postpone California's unprecedented recall election unless Monterey County and state officials can get federal clearance to proceed with the vote.

U.S. District Judge Jeremy Fogel ordered attorneys from the state Department of Justice and Monterey County back into court on Aug. 29 to show why the election should move forward. In the meantime, he told the county's election officials to refrain from sending out 200 absentee ballots to overseas voters.

Fogel's orders came hours after civil rights groups argued that the unusual election is so rushed that it is forcing changes in the voting process that require federal approval.
